Blue Water Veterans – Agent Orange
In addition to other VA claims, we also handle “Blue Water Veterans” cases. Veterans or Widows of deceased Veterans who served in Vietnam in the US Navy may now able to receive Agent Orange benefits under Public Law 116-23 also known as the Blue Water Navy Vietnam Veterans Act of 2019 which extends the presumption of herbicide exposure to Veterans serving within the offshore waters of the Republic of Vietnam and further provides a potential earlier effective date for DIC claims and service connected claims that were previously denied. Blue Water claimants may also be eligible for an earlier retroactive effective date for claims filed on or after September 25, 1985 and before January 1, 2020 that were previously denied. Veterans with herbicide exposure are presumably deemed to have the conditions set forth in 38 C.F.R. Section 3.309(e) which include Parkinson’s disease, early onset peripheral neuropathy, chronic B-Cell leukemia, diabetes mellitus Type 2, ischemic heart disease, prostate cancer, respiratory cancers such as lung, bronchus, larynx or trachea, Hodgkin’s lymphoma and non-Hodgkin’s lymphoma.
